Terms of Service

1. Who we are

Bleepless AI (https://bleepless.com) is operated by Smoltech, LLC, a Delaware limited liability company (file number 10799869), 131 Continental Dr, Suite 305, Newark, DE 19713, USA (“we”, “us”). You can reach us at support@bleepless.com. By using Bleepless AI you agree to these terms. If you don’t agree, don’t use the service.

2. Eligibility

You must be 18 or older, or the age of majority where you live if that is higher. Bleepless AI contains mature themes and strong language. By using the service you confirm that you meet this age requirement and that using it is legal where you are. If we learn that an account belongs to someone under 18, we will close it and delete its data.

3. Your account

You can start a chat without an account, but replies need a paid plan: there is no free plan. When you subscribe, we create your account from the email you pay with, or add the plan to your existing account with that email. Keep your sign-in details and email inbox secure. You are responsible for all activity on your account. One person per account: don’t share or sell access.

4. The service

Bleepless AI is an AI assistant for chat and creative writing, including stories, roleplay, Reddit-style posts and threads. It is uncensored in a specific sense: no lectures, swearing is fine, dark and violent fiction is fine, and controversial, taboo and political questions get honest answers. Roasts and edgy humour are welcome.

Sexual content is not allowed on any plan, and romance in stories stays fade-to-black. What is off limits is set out in section 6 and in our content rules.

Plans. Trial: $2.90 today for 7 days, then $14.90/month until you cancel. Pro: $14.90/month. Max: $29.90/month, with 5 times Pro’s usage. Max 20x: $99/month, with 20 times Pro’s usage. Each plan has a weekly usage limit, counted over the last 7 days, based on how much the AI writes for you; longer replies use more of it. Plans use different configurations of our model (Zouk 1, Zouk 2, Helios 1), which differ in maximum reply length and how much of a chat the model remembers. We may change, add or remove features over time. If we make a change that materially reduces what a paid plan includes, we’ll tell you in advance.

5. AI output

Replies are generated by an AI system. Please keep in mind:

• Output may be inaccurate, incomplete, offensive, or entirely made up. Fiction is fiction.
• It is not professional advice. Don’t rely on it for medical, legal, financial, mental health or safety decisions.
• Similar prompts can produce similar output for other users, so output may not be unique to you.
• You are responsible for how you use output, including anything you publish or share. Check facts, follow the rules of wherever you post, and label fiction as fiction.

6. Acceptable use

You agree not to use Bleepless AI to create, request or share:

• sexual content of any kind;
• anything involving minors in a sexual or romantic context;
• sexual content about real, identifiable people;
• instructions that enable real-world harm, including weapons, explosives, drug synthesis, hacking, fraud, malware, or methods of self-harm or suicide;
• content intended to harass, threaten or dox a real person.

You also agree not to:

• use the service for anything illegal, or to help someone else break the law;
• try to bypass, disable or trick our safety systems, limits or age requirement;
• scrape the service, access it by automated means, or resell or redistribute access to it;
• get around usage limits, for example by sharing an account or automating requests;
• probe, overload or interfere with the service or its security.

We screen prompts automatically, may refuse any request, and may suspend or close accounts that break these rules. Where the law requires it, we report illegal content to the relevant authorities.

7. Subscriptions, billing and auto-renewal

Prices are in US dollars, and taxes are added where we are required to collect them. By subscribing, you authorise us to charge your payment method every month until you cancel. Payments are processed by Stripe. Charges appear on your statement as BLEEPLESS AI.

Trial. The trial costs $2.90, charged when it starts, and gives you 7 days of access. Unless you cancel before it ends, it converts to Pro and we charge $14.90/month from day 8, then every month until you cancel. One trial per person.

Upgrades. When you upgrade, the new plan starts right away and we charge the prorated difference for the rest of the current period to your saved payment method. Upgrading during a trial ends the trial and starts the new plan’s first month.

If a payment fails, Stripe may retry it over the following days. If it can’t be collected, your plan ends. If we change a plan’s price, we’ll tell you in advance, and the new price applies only from a renewal after that notice. You can cancel before then.

8. Cancellation and refunds

Cancel anytime from Account → “Manage or cancel”. You keep your plan until the end of the period you’ve paid for, and you won’t be charged again. We don’t refund partial periods, except where the law requires it. Our Refund & Cancellation policy explains how cancelling works and how to ask for a refund in exceptional cases. It forms part of these terms.

9. Your content and our rights

Yours. As between you and us, you own what you type in (your inputs) and, to the extent the law allows, what the service generates for you (your outputs). You are responsible for making sure your inputs don’t infringe anyone else’s rights.

Licence to us. You give us a non-exclusive, worldwide, royalty-free licence to host, process, transmit and display your inputs and outputs only as needed to run, secure and support the service, and to enforce these terms. We don’t use your chats to train AI models.

Ours. The Bleepless AI name, logo, website, software and design belong to us or our licensors. You may not copy, modify or reverse-engineer them, or use our name or logo without our written permission.

10. Suspension and termination

You can stop using Bleepless AI at any time, and ask us to delete your account by emailing support. We may suspend or close your account, with or without notice, if you break these terms, if we must do so by law, or if your use puts other people or the service at risk. If we close a paid account for a serious or repeated breach, we won’t refund the remaining period. If we shut down the service for reasons unrelated to you, we’ll refund the unused part of your current period.

Sections 5, 9, 11, 12, 13 and 14 continue to apply after your account ends.

11. Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise the service will be uninterrupted, error-free or always available, or that output will meet your expectations.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by our negligence. Nothing in these terms limits the mandatory consumer rights you have where you live.

13. Indemnity

To the extent the law allows, you agree to defend and indemnify Smoltech, LLC against claims, losses and costs (including reasonable legal fees) that arise from your breach of these terms, your misuse of the service, or content you publish or share.

14. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts located in Delaware. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also be able to bring a claim in your local courts.

Talk to us first. If something goes wrong, email us. Most problems can be fixed quickly without going to court.

15. Changes

We may update these terms. If a change matters, we’ll tell you by email or on the site before it takes effect. The date at the top shows the current version. If you keep using the service after a change takes effect, you accept the new terms.
